Being a member of a 12-step program, I spend my nights in rooms with people who are trying to be better humans. The people in my program are trying to live authentic lives, and we learn to make amends when we were wrong. We learn to clean up the wreckage of our past. We learn that being better humans is an inside job.
We also pray to be of service to others and learn how to maintain integrity when life gets lifey.
As I listen to Moby’s interview with Hunter Biden this morning, listening to how human he is, understanding what it’s like to burn down your life and land in our rooms, embraced and loved — loved by the group until we learn to love ourselves — I am heartened that he has the tenets of our simple program to survive the ongoing assaults by the Russian war machine and Roger Stone’s pure evil that guns for him daily because his father represents such a threat to autocrats everywhere. Truly, all that stands between an authoritarian US and a democratic US is his father, and we voters. So the Russian war machine and US traitors attack the son to hurt the father.

As a woman in recovery who uses the tools I have learned in my simple program for complicated people to deal with the attacks and threats I receive daily for my work now going on seven years, I hope many of you will hear Hunter’s words and think, “There but for the grace of God go I….”

FREE ADVICE FROM MARTY
Now, to the brass “tax” we go…
Retired IRS criminal investigator Martin Sheil has some advice for Hunter Biden, who was newly charged in the ongoing saga to taint his father’s popularity by using his son as a proxy.

I got caught up in the Hunter Biden saga and put down some thoughts and observations.
Let’s think of this as a play…
Hunter Biden Drama
Act One - Congressional Impeachment Hearing Subpoena
Hunter Biden should show up on the steps of the Capitol Building just outside the door at 9:30 am on December 13 after notifying the media of his intentions to do so, and then proclaim his willingness to answer questions at that time and place in full view of the press.
Naturally, should Comer and Jordan et al come out and begin questioning him, Hunter should take the 5th since he has just been indicted and anything he says could be held against him.
Act Two - Indictment
Odds on a Jury convicting Hunter of any charges reflected in the Indictment as it stands right now without hearing any Defense:
7203 charges 50%
7201 charges 20%
7206(1) charges 75%
Why?
7203 charges require as an element of the crime - tax due and owing. Hunter has already paid all taxes + interest. Government is left with the technicality that Hunter did not pay timely. How many people in the throes of their addiction pay any of their bills timely?
7201 Evasion of Assessment
Really? How many of these cases has the Government EVER successfully prosecuted? How many recovering addicts has the government ever successfully prosecuted under this statute?
Any?
Felony Evasion charges require oodles of evidence of Intent, particularly when elevating a prospective Misdemeanor charge to a Felony (U.S. v Spies). Where is the evidence of Wilfullness defined as Concealment, Secrecy, Deception, Misrepresentation necessary to sustain this charge? How does the government prove a drug addicted defendant possessed sufficient Mens rea to intentionally, willfully Evade assessment of his taxes? Jury buys Hunter defense sob story here that he was self medicating over the loss of his brother and got lost in a world of drugs and alcohol.
7206(1) Falsifying tax return(s)
Hmmmm - Government does NOT need to prove tax due and owing. Charge lies somewhere between a full Felony and Misdemeanor meaning less amount of Evidence of Intent required; Defendant claiming Sex club expenses as a business expense will get all of the Jury's attention!!!!
Ding, ding, ding - Government prevails here.
Hunter should plead to 7206(1) which has a 3-year maximum exposure and take his chances at Sentencing which will likely be parsed out in months.
Should the Judge actually sentence any real prison time - his father does have pardon power!
Best option for Hunter - plead to a single count of 7206(1) and don't wait until the last minute thereby pissing off the Judge who will be in charge of Sentencing.
Remember the last time the Hunter team pissed off a Judge...
So there you have it.
Act Three
Hunter decides to take his chances in court in lieu of submitting a plea. He gets convicted on some of the tax charges and appeals. Appeal takes a long time and in the mean time — God forbid — Donald Trump gets elected to the Presidency despite being convicted on multiple felony charges. He appeals. While waiting the results of the appeal he implements his Dictatorship as promised.
His first appointment is Stephen Miller as Oberfuhrer - Attorney General. Miller is directed to indict all media who wrote anything nasty about "the Donald" and hurt his sensitive feelings.
Heidi and Marty start emailing each other from their respective prison cells comparing the enormity of vermin they share cells with. Also compare quality of pizza since that is a prison staple at all Federal prisons. (Author’s note: Heidi will demand a vegan diet like the QAnon Shaman, or go on hunger strike, thus garnering international sympathy).
Many of the respective emails start with a nostalgic - Remember when...like remember when Steve Bannon was viewed as a Fascist buffoon and now he is the President's Chief of Staff.
Or remember when Kash Patel was viewed as somewhere between a lunatic and a complete clown and now he runs the Pentagon...
Time to go Heidi. I am going to chew on some stale pizza for breakfast and start conditioning myself for what is coming...
