‘Some Serious Horseshit’ — Marty Investigates if the Comey Case is ‘Chickenshit’ in this Guest Op-Ed

Guest Op-Ed: Is the Comey Case Chickenshit?

So I asked Jesse Eisinger — the guy who literally wrote the book The Chickenshit Club about prosecuting ‘Chickenshit’ cases — about the Comey case, and here is what he had to say:
“It’s not a ‘Chickenshit’ case. ‘Chickenshit’ refers to the unwillingness or inability to bring legitimate, righteous cases against powerful individuals. The Comey indictment, by contrast, is a Rotten Action, brought clearly at the improper instigation of President Trump, for the purposes of revenge and to silence critics. This is a perversion of justice.”
So will justice be done in the Comey case?
Chances are good to excellent that this indictment will be dismissed by the U.S. district court judge in this case, based on the expected motion to dismiss that will likely be filed by Patrick Fitzgerald — Comey’s defense lawyer.
Fitz was a long time US Attorney of the Northern District of Illinois who successfully prosecuted two Illinois Governors for corruption-related charges.
Fitz is expected to file a motion to dismiss the Comey case based on ‘Selective Prosecution’ assertions by the defense that will rely heavily on President Trump’s own words and directions to his Attorney General asserting the need for retribution.
The DOJ prosecutor Lindsey Halligan, who was at one time a personal attorney for Trump, has never actually prosecuted a case with her legal experience mostly based in insurance law (cough cough ambulance chaser). Ms. Halligan is a past beauty pageant winner, however, and will certainly look good when conducting daily press briefings during the course of the Comey legal proceedings.
Halligan is also prosecuting Letitia James — the AG of New York — for alleged mortgage fraud. Halligan noted in the cover sheet for the James indictment that James resided in Brooklyn, New Jersey, which came as a shock to both New Yorkers and New Jerseyans.
Halligan’s obvious inexperience as a prosecutor will likely present no match for James’ defense attorney Abbe Lowell, who possesses years of courtroom experience both as a prosecutor and high-level criminal defense attorney. Lowell is also expected to file a motion to dismiss the indictment against James based on selective prosecution, along the same retribution lines that Fitzgerald will file in the Comey case.
I agree with Eisinger that the Comey and James cases are not ‘chickenshit cases’, but both are perversions of justice, and I will go on the record and say that if the federal judges in both cases do not dismiss these clear cut cases of retribution then that will be some serious horseshit.

Author’s note: One of my favorite memories of interviewing Marty was when he explained the difference between a mob criminal defense lawyer and a government prosecutor. The criminal defense lawyer has a thousand dollar haircut and sports a handmade Italian suit, while the prosecuting attorney has a $7 dollar haircut and got his suit at a two-for one sale.
