‘The dam could be bursting’ — retired IRS criminal investigator Martin Sheil on Sidney Powell’s guilty plea
I woke up to a call from HiFi about Sidney Powell’s guilty plea in the case over attempts to overturn Trump’s Georgia loss.
Rarely have I heard my podcast partner sound so gleeful because Powell — who is receiving six years probation — has agreed to testify truthfully in future trials against her co-defendants.
Here are some details from AP:
Lawyer Sidney Powell pleaded guilty to reduced charges Thursday over efforts to overturn Donald Trump’s loss in the 2020 election in Georgia, becoming the second defendant in the sprawling case to reach a deal with prosecutors.
Powell, who was charged alongside Trump and 17 others with violating the state’s anti-racketeering law, entered the plea just a day before jury selection was set to start in her trial. She pleaded guilty to six misdemeanors accusing her of conspiring to intentionally interfere with the performance of election duties.
As part of the deal, she will serve six years of probation, will be fined $6,000 and will have to write an apology letter to Georgia and its residents. She also agreed to testify truthfully against her co-defendants at future trials.
Lest we forget, the Dominion Voting Systems lawsuit against Fox revealed even their lying anchors think Powell is a liar. According to court docs, Tucker Carlson wrote that Powell was lying. “It’s insane.” And Laura Ingraham responded: “Sidney is a complete nut. No one will work with her. Ditto with Rudy.”
Because it was clear from watching the new Roger Stone film that the architects of the Big Lie have not yet been charged, it was my hope that Powell being forced to be truthful might be able to help ring up some high-level traitors.
So to the Marty I go.
I reached out to ex-fed Martin Sheil to get the skinny.
Here are four questions/comments with Marty regarding Powell’s plea:
Me: Why just probation? They tried that with Flynn when he originally pleaded guilty to lying to the FBI, and then Powell stepped in.
Marty: She will be disbarred. Her real life is over. She can go cry on Mike Flynn’s shoulder and write a book when this is all over. Meanwhile, the prosecutor can use her testimony to walk the jury through the entire Conspiracy including direct testimony on all of her fellow co-conspirators. From the prosecution perspective, her testimony is invaluable plus her plea may now generate further critical pleas.

Me: Hoping she takes Flynn down, but I won’t hold my breath…
Marty: No that won’t happen. Flynn was a client. She cannot violate attorney client privilege. They are friends, however, and both are pretty nutty so at some point maybe they will find themselves residing in the same sanitarium.
Me: Even if the client committed criminal acts after she repped him?
Marty: Very dicey. Not sure her testimony would be admitted. It certainly would be challenged by the defense, and if admitted would be appealable. How does the prosecution determine just when Powell stopped representing Flynn? Most prosecutors will shy away from that hornet’s nest.
So to those who might ask — why wouldn’t the attorney client privilege apply to her testimony against Trump? Because she is involved in the same crime as Trump - Conspiracy to Commit Election Fraud - therefore the Crime/Fraud exception to the privilege applies, and she can violate the privilege and testify.
Me: Thank you for that clarification. Also, you predicted this previously, that the best option for those charged would be to line up and plea guilty early.
Marty: Yes, I predicted somewhere along the line that pleas could be expected pre-trial and the early worm gets the best deal. Powell fits the description of a worm in every way given that context.
